Property acquisition
Until recently it was considered by most legal advisors that the ownership of land by a foreigner through a Thai Limited Company was acceptable, although the Law clearly states that foreigners per se cannot own land. Direction from the Government has now clearly stated that such ownership may be illegal. The legitimacy of such ownership depends on the status of the Thai Shareholders who must be shown to be active and financially participating shareholders. The alternative method of acquisition is by entering into a 30 year lease on the land. Options for further terms cannot exceed a further 30 years and may have no value even if registered. An option with a management company is however in our opinion more secure than with an individual. Any building on the land can be owned by a foreigner personally and registered as such at the Land Office. Currently we are seeing Lawyers creating various structures of ownership which they regard as acceptable within Thai Law. We would not argue with the Lawyers, but our opinion is that until clearer guidelines are established by the Government, foreign buyers would be advised to enter into the 30 year lease of the land and include an option to purchase at an agreed figure, or extend the lease if such extensions become available, should the law change favourably in the future.
